Who we are and what this policy covers

This Privacy Policy describes how MB Purai, a company registered in the Republic of Lithuania, company number 307180205, VAT number LT100019104415, registered address Tuskulėnų g. 24-37, LT-09211 Vilnius, Lithuania, trading as AIclicks (“AIclicks,” “we,” “us,” and “our”), collects, processes, and discloses Personal Information through our website at www.aiclicks.io (the “Site”), the AIclicks platform, the API, and our related applications (the “Services”). Together, the Site and Services are referred to as our “Products”.

This Privacy Policy applies to Personal Information for which we determine the purposes and means of processing, which is to say where we act as a controller. We act as a controller when we collect Personal Information for our own purposes, including through the Site, when you register an account, and when you contact us. It does not apply to Personal Information we process as an employer.

This Privacy Policy does not apply to Personal Information we collect or process on behalf of our customers when they use our Products. In those cases our customer is the controller of the Personal Information collected, processed, or generated through their use of the Products, and we act only as a processor on that customer’s documented instructions, as set out in Section 9 of our Terms of Service. If your Personal Information is handled by one of our customers, that customer is responsible for telling you how, and you should read their own privacy notice.

This Privacy Policy does not apply to information that does not identify an individual, including anonymous, de-identified, and aggregated information.

Please read this Privacy Policy before using our Products. It is incorporated into, and forms part of, our Terms of Service at www.aiclicks.io/terms-and-conditions.

1. What Personal Information We Collect

1.1. “Personal Information” means information that identifies you or another individual, either directly or indirectly. We may collect the following categories.

1.2. Account information, including your full name, email address, billing and postal address, VAT number, company name and your role, account login credentials and authentication data, API keys and tokens, and your profile settings.

1.3. Billing information, including your billing address, VAT status, plan, invoice history, and the last four digits and expiry of your payment card. We never receive or store your full payment card number. Card details are collected and held by our payment processor.

1.4. Site usage information, including the pages you visited, how you arrived, visit frequency and duration, the links you clicked, your approximate location derived from IP address, your browser and device type, and your IP address.

1.5. Product configuration information, including the brands, domains, competitors, prompts, topics, regions, and models you choose to track, your workspace and team settings, your brand tone and messaging configuration, and any integrations you connect.

1.6. Product usage information, including feature usage, dashboard interactions, reports and articles generated, export activity, API usage and query frequency, and diagnostic and performance logs.

1.7. Communications, including the content of support tickets, emails, chat messages, demo and sales calls, survey responses, and any feedback you send us.

1.8. Marketing information, including your subscription preferences and whether you opened or clicked our emails.

1.9. We do not seek to collect special category Personal Information as defined in Article 9 of the GDPR, and you should not submit it to the Products. Where we do receive it, we process it only with your explicit consent or where another lawful ground in Article 9 applies.

2. How We Collect Personal Information

2.1. Directly from you, when you create or register an account, start a trial, subscribe, configure the Products, contact us, book a demo, complete a form, or subscribe to our emails.

2.2. Automatically, when you visit the Site or use the Products, through server logs, cookies, and similar technologies as described in Section 7.

2.3. From third parties, including our payment processor, our analytics and marketing platforms, single sign-on providers when you sign in with Google or Microsoft, and publicly available sources such as company websites and professional networks where we research prospective customers.

2.4. From your organisation, where a colleague invites you to a workspace or an administrator creates an account for you.

3. How We Use Personal Information

3.1. To provide, operate, maintain, and secure the Products, including creating and administering your account and workspace, running the analyses you configure, and generating the reports and content you request.

3.2. To process payments, issue invoices, apply VAT correctly, manage subscriptions and renewals, collect amounts owed, and detect and prevent payment fraud and trial abuse.

3.3. To provide customer support, respond to your questions, and investigate and resolve incidents.

3.4. To improve and develop the Products, including analysing feature usage, diagnosing faults, and testing changes. Where we use Product data for improvement and benchmarking, we do so in anonymised, de-identified, or aggregated form that does not identify you, your organisation, or any individual.

3.5. To communicate with you about your account, including service, security, billing, and legal notices. You cannot opt out of these, because they are necessary to provide the Products.

3.6. To send you marketing communications about our Products, where you have subscribed or where we are otherwise permitted to do so. Every marketing email carries a one-click unsubscribe, and unsubscribing does not affect your account.

3.7. To protect the Products and other customers, including enforcing our Terms of Service, applying rate limits, and investigating suspected misuse, security abuse, or unlawful activity.

3.8. To comply with our legal obligations, including tax, accounting, and record-keeping law, and to establish, exercise, or defend legal claims.

3.9. Automated decision-making. The Products generate scores, rankings, and recommendations about brands, not about people. We do not make decisions producing legal or similarly significant effects concerning you based solely on automated processing.

4. Lawful Basis for Processing

4.1. Where the GDPR applies, we rely on the following lawful bases under Article 6.

4.2. Performance of a contract, for creating and administering your account, providing the Products, processing payments, and providing support. This covers Sections 3.1 to 3.3 and 3.5.

4.3. Legitimate interests, for improving and securing the Products, preventing fraud and abuse, understanding how the Site is used, and marketing to business contacts. This covers Sections 3.4, 3.6, and 3.7. Our legitimate interest is in running, protecting, and growing our business, and we balance it against your rights and freedoms. You may object at any time under Section 10.

4.4. Consent, for non-essential cookies and for marketing where consent is required. You may withdraw consent at any time, and withdrawal does not affect processing carried out before you withdrew it.

4.5. Legal obligation, for tax, accounting, and other statutory record-keeping, and for responding to lawful requests from authorities. This covers Section 3.8.

5. Disclosure of Personal Information

5.1. We do not sell your Personal Information, and we do not share it for cross-context behavioural advertising.

5.2. Service providers and sub-processors. We disclose Personal Information to third parties that help us run the Products, including cloud hosting providers, infrastructure and proxy providers, our payment processor, analytics and email platforms, customer support and CRM tools, and third-party large language model providers. They may process Personal Information only on our instructions and under written terms, and a current list of our sub-processors is available on request at support@aiclicks.io.

5.3. Within your organisation. Where you use the Products through a workspace, your account information and activity may be visible to your workspace administrators and other authorised users of that workspace.

5.4. Professional advisers, including our lawyers, accountants, auditors, and insurers, where they need it and are bound by confidentiality.

5.5. Legal and regulatory disclosure, where we are required by applicable law, a court order, or a competent authority, or where disclosure is necessary to establish, exercise, or defend legal claims, protect the rights and safety of any person, or investigate fraud or a security incident.

5.6. Corporate transactions. If we are involved in a merger, acquisition, financing, reorganisation, or sale of all or part of our business, Personal Information may be transferred as part of that transaction, subject to the receiving party continuing to honour this Privacy Policy.

6. International Transfers of Personal Information

6.1. We are established in Lithuania and process Personal Information in the European Economic Area, but providing the Products involves transfers outside the EEA, including to the United States.

6.2. Where we transfer Personal Information outside the EEA to a country without a European Commission adequacy decision, we rely on European Commission standard contractual clauses or another lawful transfer mechanism, together with supplementary measures where appropriate.

7. Cookies and Similar Technologies

7.1. We use cookies and similar technologies on the Site and in the Products.

7.2. Strictly necessary cookies keep you signed in between sessions, keep your session secure, remember your workspace, and allow the checkout to function. These cannot be switched off, because the Products do not work without them.

7.3. Analytics cookies tell us which pages are visited, how visitors arrive, and where they encounter problems, so that we can improve the Site and the Products.

7.4. Marketing cookies measure the performance of our campaigns and let us reach people who have shown interest in us.

7.5. We set non-essential cookies only where you consent. You can change or withdraw your choice at any time, and you can also block or delete cookies in your browser settings, though some features will stop working if you block strictly necessary cookies, including staying signed in.

8. Securing Your Personal Information

8.1. We implement and maintain reasonable administrative, technical, and organisational measures designed to protect Personal Information against unauthorised access, loss, alteration, and disclosure, including encryption in transit and at rest, role-based access control, and least-privilege access for our personnel.

8.2. Access to production systems is restricted to personnel who need it, and everyone with access is bound by confidentiality obligations.

8.3. No internet transmission or storage system is completely secure. We cannot guarantee absolute security, and this Section is not a warranty of any particular security outcome.

8.4. Breach notification. Where a personal data breach is likely to result in a risk to your rights and freedoms, we will notify the competent supervisory authority within seventy-two (72) hours of becoming aware of it, and will notify you without undue delay where the breach is likely to result in a high risk to you. Where we act as a processor for one of our customers, we notify that customer instead, on the timetable in Section 9.6 of our Terms of Service.

8.5. You are responsible for keeping your own credentials and API keys secure, and for telling us promptly at support@aiclicks.io if you believe your account has been compromised.

9. Retaining Your Personal Information

9.1. We keep Personal Information only for as long as we need it for the purposes described in this Privacy Policy, and then delete it or irreversibly anonymise it.

9.2. Account and workspace data is retained for the life of your subscription. On termination it is handled under Section 3.9 of our Terms of Service: a thirty (30) day export window, deletion from active production systems within thirty (30) days after that window closes, and removal from encrypted backups in the ordinary rotation within ninety (90) days.

9.3. Billing and tax records are retained for as long as Lithuanian tax and accounting law requires, which is generally ten (10) years, regardless of account closure.

9.4. Support and sales communications are retained for up to three (3) years after the last contact.

9.5. Marketing contact data is retained until you unsubscribe or object, and we then keep a minimal suppression record so that we do not contact you again.

9.6. Site analytics data is retained in identifiable form for up to twenty-six (26) months.

9.7. We may retain Personal Information for longer where required by law or where it is necessary to establish, exercise, or defend legal claims, and for that purpose only.

10. Your Data Protection Rights

10.1. Where the GDPR applies, you have the following rights in relation to your Personal Information.

10.2. Access. To be told whether we process your Personal Information and to receive a copy of it.

10.3. Rectification. To have inaccurate Personal Information corrected and incomplete Personal Information completed.

10.4. Erasure. To have your Personal Information deleted where one of the grounds in Article 17 applies.

10.5. Restriction. To have our processing restricted where one of the grounds in Article 18 applies.

10.6. Portability. To receive Personal Information you provided to us in a structured, commonly used, machine-readable format, and to have it transmitted to another controller where technically feasible.

10.7. Objection. To object at any time to processing based on our legitimate interests, including profiling, and to object at any time and without giving a reason to processing for direct marketing, which we will always honour.

10.8. Withdrawal of consent. To withdraw consent at any time where we rely on it, without affecting processing carried out beforehand.

10.9. How to exercise your rights. Write to us at support@aiclicks.io. We will respond within one (1) month, and may extend that by two (2) further months for complex or numerous requests, telling you if we do. We may ask you to verify your identity before we act. Exercising these rights is free, unless a request is manifestly unfounded or excessive.

10.10. Requests about data we process for a customer. Where we act as a processor rather than a controller, we will refer your request to the relevant customer, who is the controller and is responsible for answering it.

10.11. Right to complain. You may lodge a complaint with your local supervisory authority. We would rather you came to us first so we can put the problem right.

11. Children and Minors

11.1. Our Products are for business use and are not directed at children. We do not knowingly collect Personal Information from anyone under 18.

11.2. If you believe a child has provided us with Personal Information, contact us at support@aiclicks.io and we will delete it.

12. Changes to This Privacy Policy

12.1. We may update this Privacy Policy from time to time. We will post the updated version with a new “Last updated” date, and where a change is material we will give at least thirty (30) days’ notice by email or in the Products before it takes effect.

12.2. Continued use of the Products after a change takes effect means you accept the updated Privacy Policy. Changes required for legal, regulatory, or security reasons may take effect immediately, and we will notify you as soon as we reasonably can.

12.3. Where you hold Enterprise Services, the change process in your Subscription Services Agreement applies in place of this Section.
